Position Overview

The Labor Compliance Manager reports to the Vice President of Human Resources and is responsible for labor compliance, including prevailing wage and certified payroll, across GrayMar’s national footprint. This role ensures that GrayMar meets its obligations under federal and state prevailing wage laws, apprenticeship requirements, and related labor regulations. The Labor Compliance Manager provides direct oversight of certified payroll reporting, leads internal training on wage and hour requirements, manages compliance monitoring software, and serves as the primary point of contact for government inquiries, audits, and multi-employer arrangements.

Key Responsibilities

Certified Payroll and Prevailing Wage Compliance

  • Provide direct oversight of day-to-day operations as they pertain to environmentally certified payroll reporting, including Davis-Bacon Act, State/County/City Prevailing Wage, Apprenticeship, and workforce requirements.
  • Monitor and stay current on applicable laws and regulations that may affect policies and procedures; develop and implement solutions to maintain compliance.
  • Communicate regulatory changes and new wage determinations; update internal compliance materials accordingly.
  • Research and document prevailing wage requirements whenever GrayMar enters a new state or jurisdiction, including registration obligations, wage determination sources, certified payroll formats, and enforcement agency contacts.
  • Monitor wage determinations for modifications or escalation clauses; notify Payroll of required rate adjustments in a timely manner.
  • Identify correct craft classifications for each project scope; submit conformance requests (SF-1444 or state equivalent) when required classifications are absent from posted wage determinations.
  • Clearly communicate to the Payroll the applicable overtime trigger for each state and project type, including daily, weekly, double time, or combination requirements, along with meal and rest break premium pay obligations and fringe benefit credit rules where applicable.
  • Compile and review documents for third-party and government reviews, audits, and inquiries, working in conjunction with appropriate departments and the Labor Compliance team.
  • Provide direct oversight of proper integration and usage of LCP Tracker and other compliance monitoring software to meet reporting requirements.
  • Track audit findings and ensure required corrective actions, back wages, or restitution payments are processed accurately and in a timely manner.
  • Ensures communication to subcontractors and monitors subcontractor certified payroll submissions for completeness and compliance; as prime contractor, GrayMar bears joint liability for subcontractor prevailing wage violations across all tiers. Follow up promptly on missing, late, or deficient submittals.
  • Verify fringe benefit compliance on prevailing wage projects; confirm that health, pension, vacation, and other fringe contributions are properly documented and applied as credits against prevailing wage obligations in accordance with applicable wage determinations.
  • Coordinate and attend pre-construction labor compliance meetings with project teams and subcontractors prior to project kickoff to communicate wage rates, worker classification requirements, certified payroll reporting deadlines, and employee rights obligations.
  • Ensure required labor law posters and applicable wage determinations are posted in prominent, accessible locations on all applicable job sites in accordance with DOL and state agency requirements.
  • Maintain certified payroll records, statements of compliance, fringe benefit documentation (if appropriate), and related project labor records in accordance with applicable retention requirements (minimum three years post-contract completion under Davis-Bacon; longer as required by state law or contract).
  • Support or facilitate worker wage rate interviews conducted by DOL, DIR, or other regulatory agencies during compliance audits or investigations; ensure workers are made available and that GrayMar’s cooperation obligations are met.

Apprenticeship Compliance

  • Confirm that GrayMar holds valid apprenticeship training contributions and/or California DAS approval (DAS-140/DAS-142) on applicable California public works projects.
  • Calculate required apprenticeship utilization ratios by craft and project; report utilization status to Payroll and Project Management regularly and request registered apprentice dispatches when shortfalls are identified.
  • Prepare and submit apprenticeship exemption requests when applicable; maintain complete documentation of all filings.

Training and Team Management

  • Develop and deliver prevailing wage training for field supervisors, foremen, and project managers covering worker classification, timekeeping requirements, employee rights, and consequences of noncompliance.
  • Train Payroll staff on jurisdiction-specific wage rates, overtime triggers, fringe benefit credit rules, and certified payroll reporting as new projects and states are added; maintain training records.
  • Assist in onboarding and training managers on certified payroll processes; onboard site management, executive administrators, and divisional leadership as needed.
  • Manage and schedule labor compliance training classes and seminars; coordinate job assignments and cross-training as needed.
  • Ensure team member deadlines and commitments are met; provide feedback to upper management on employee work performance and recommend resources to ensure business needs are met.
  • Manage the balance of workload to staff ratio and provide recommendations to ensure business needs are met.
  • Create and maintain strong working relationships with internal stakeholders, project teams, and external agencies.

Multi-Employer and Staffing Agency Arrangements

  • Identify joint venture, labor broker, or staffing agency arrangements on public works projects and determine applicable prevailing wage obligations and reporting responsibilities for each party.
  • Ensure staffing agencies supplying workers to GrayMar public works projects are informed of and comply with prevailing wage requirements, including correct classification and certified payroll reporting.
  • Verify debarment and suspension status of subcontractors, vendors, and labor brokers on public works projects prior to engagement and periodically throughout project performance; flag any debarred parties to project management and legal counsel immediately.
  • Coordinate with legal counsel when multi-employer arrangements present ambiguous compliance obligations or liability exposure.
  • Ensure compliance with all organizational policies and procedures.
  • Perform other related duties as assigned.

Required Skills/Abilities:

  • Thorough knowledge of the Davis-Bacon Act and Related Acts (DBRA), Contract Work Hours and Safety Standards Act (CWHSSA), and Copeland Anti-Kickback Act requirements.
  • Working knowledge of California prevailing wage law (Labor Code §§1720 et seq.), DIR/DLSE enforcement procedures, and DAS apprenticeship requirements.
  • Familiarity with California, Washington, Oregon BOLI, Washington L&I, Nevada Labor Commissioner, or comparable western state prevailing wage frameworks.
  • Proficiency in certified payroll formats (WH-347, California A-1-131, Oregon WH-38) and electronic submission platforms (LCPtracker, eCPR, or comparable).
  • Strong analytical and research skills; ability to resolve novel compliance questions through regulatory websites, agency portals, and legal references.
  • Excellent written communication skills; experience drafting professional correspondence to government agencies.
  • Proficiency in Microsoft Office (Word, Excel); experience with payroll systems such as Enhance HCM, ADP, or Foundation Software is a plus.
  • Strong interpersonal and relationship management skills; ability to collaborate effectively with payroll, project management, operations, and legal teams.
  • Demonstrated ability to manage multiple compliance deadlines simultaneously across multiple jurisdictions and project types.

Education and Experience:

  • Bachelor’s degree in Business Administration, Legal Studies, Human Resources, Construction Management, or a related field; equivalent work experience considered.
  • Minimum 5 years of experience in payroll, prevailing wage compliance, certified payroll administration, or compliance management on public works projects.
  • Experience managing or supervising a compliance team preferred; demonstrated ability to train and develop staff.
  • Experience with LCPtracker, eCPR, or equivalent compliance monitoring software required.
  • Prior experience in environmental services, construction, hazardous waste management, or related field industries preferred.
