Job Summary
The Litigation Specialist oversees the portfolio contested foreclosure volume and bankruptcy adversary proceedings pursuant to investor guidelines, and PHL policies and procedures.
In addition, this role is provides analysis on risk assessment, resolving documented complaints, and provides qualified recommendations through resolution. Also prepares answers and responses to discovery in contested foreclosures and adversarial bankruptcies through attending depositions, trials, and mediations when necessary.
Essential Duties and Responsibilities
Monitors progress of the contested foreclosure action, including management of issues raised, holds placed, and research required to complete the contested foreclosure action, judicial and non-judicial in accordance with applicable policies and procedures.
Works and communicates with foreclosure attorneys to understand, minimize, and avoid delays during the foreclosure to allow completion of the foreclosure action. Researches and reviews information needed to prepare answers and responses to discovery in contested foreclosures and adversarial bankruptcies.
Coordinates with management, in-house legal department, attorneys, and vendors to ensure compliance with case management standards, applicable court rules, and procedures.
Attends depositions, trials, and mediations when PHL is required to provide testimony related to debt or servicing functions. This could involve some out of state travel.
Assists Consumer Affairs Manager in researching and resolving default servicing related complaints and qualified written responses through Everest.
Effectively manages counsel through timeline management, active communication, and in-person contact or meetings.
Maintains detailed loan status and records of litigated/contested cases within MSP/LoanSphere and Planets imaging system.
Communicates and interacts effectively with all levels of employees and management, as well as borrowers, clients, and outside vendors.
Performs other responsibilities and duties as assigned by Manager and Supervisor of the Default Litigation Department.
Position Requirements
Education
Bachelors degree or equivalent work experience required.
Experience
Minimum of 5 years experience in mortgage foreclosures and bankruptcy
Knowledge of the foreclosure and bankruptcy investor guidelines and state regulations
Knowledge of overall mortgage default servicing
Functional/Technical Skills
Excellent computer skills and ability to learn and adapt quickly to new software.
Excellent written and verbal communication skills
Self-motivated and collaborative team player with critical thinking, problem solving, mathematical and analytical skills.
Excellent project management, communication, interpersonal and research skills.
Strong organizational skills, ability to prioritize in a multi-tasking, fast-paced environment

Strong leadership skills.
Advanced knowledge of Microsoft Excel and Word
Knowledge of MSP servicing system a plus
Environmental/Physical Demands
Ability to travel when needed, estimated at 5-10%
