Description of Work

SALARY RANGE: $36,315.00 - $58,740.00

The Office of the Clerk of Superior Court, Person County, seeks an individual to serve in the position of Deputy Clerk in the legal system of North Carolina. Deputy Clerks perform specialized clerical and administrative work in a Clerk of Superior Court office that involves interacting with the public, processing initial filings, continuances, judgments, and maintaining case documentation.

Civil deputy clerks perform specialized clerical and administrative work in a clerk of superior court office that involves processing a variety of civil matters including small claims, district or superior court, including initial filings, continuances, and judgments. In the largest offices work may be specialized and involve processing a phase of a civil case such as the initial filing, continuances or judgments for one or more areas of civil district court including small claims, divorce, child custody, child support, or juvenile cases. In the smallest offices work may involve processing all phases and areas of civil cases. Work involves providing information to the public, attorneys, and others on civil forms and procedures, establishing and maintaining hard copy and electronic files, and reviewing and processing documents related to assigned cases.

As a Deputy Clerk, you may perform a variety of duties such as, but not limited to, the following:

ESSENTIAL DUTIES AND RESPONSIBILITIES:

Filings

  • Discusses and explains court rules and procedures to attorneys, the public, and others by phone or in person.
  • Listens and asks probing questions to determine the appropriate course of action; redirects to other departments as appropriate.
  • Identifies and provides applicable forms and written instructions without providing recommendations as to any specific course of action.
  • Reviews filings (complaints, petitions, affidavits) to identify issues and parties involved.
  • Issues subpoenas if applicable. 
  • Establishes and maintains case file (e.g., date-stamping, assigning a file number, issuing a summons, collecting filing fees, etc.) which includes a hard copy and data entry into the Civil Case Processing System (VCAP).
  • Completes cost sheets (indigent may require additional forms) and directs parties to cashiering to pay required fees.

Judgments

  • Processes a variety of judgments and enters into VCAP.
  • Processes writs of execution which include principal, court costs, interest, and fees.
  • Processes Notice of Right to Claim Exemptions.
  • Processes upset bids, if applicable.
  • Prepares and sends notices to appropriate parties.

Miscellaneous Responsibilities

  • Issues subpoenas on request.
  • Assists public with access to files; answers questions from public, attorneys, and others; pulls and re-files case files; provides guidance on procedures while not offering legal advice; and makes copies upon customer request
  • May assign customers a copy-key (HECON) to make copies themselves, if requested. 
  • Prepares files for destruction in accordance with Rules of Recordkeeping.  
  • Calendars cases for small claims and district court; assigns court room and date.
  • Jury clerks update Financial Management System (FMS) Jury Payment Module.
  • Child support clerks update Child Support Enforcement System (SES).
  • Bond forfeiture clerks update the Bond Forfeiture Tracking System.
  • Audits various VCAP reports (e.g., new filings, judgments, etc.); reports errors to appropriate staff for corrections.    

New hires may be paid above the minimum rate depending on education and experience in a North Carolina Clerk of Superior Court office.

Knowledge Skills and Abilities/Management Preferences

Knowledge of:  NC general statutes; policies and procedures related to the local judicial district; juvenile proceedings; eWarrants; eCourts; Odyssey Enterprise Justice, and general office and clerical procedures.

Skills in: basic math; active listening; managing a high volume of public interaction; effectively communicating both verbally and in writing; fast, accurate data entry; and MS Word, Excel, and Outlook.

Ability to: read and comprehend legal documents; interact diplomatically with a diverse group of people; multi-task; adjust to unexpected events; meet deadlines; organize and manage files; work independently; maintain confidentiality; and provide procedural information without giving legal advice.

Minimum Education and Experience

High school diploma or equivalent. Minimum of 18 years of age. Person County residents preferred.

Management prefers applicants with professional experience working in a courthouse or law office.
