Salary: $130,796 - $191,470 Depending on qualifications and experience.

DESCRIPTION:
The job of DIRECTOR OF LEGAL SERVICES - LEGAL COUNSEL participates in the definition and development of Board policies, administrative procedures, & programs, leads review & discussion of state legislative bills & state code, and provides continuing counsel and guidance on District legal matters.
In fulfilling the goals and mission of the District, the Director of Legal Services performs a variety of duties to include, but not limited to, providing legal counsel, representation, research, and conducting and overseeing investigations for the Timpanogos School District (District) as directed by and subject to the supervision of the Business Administrator, and Assistant Superintendents over Human Resources and Student & Staff Wellness. The Director of Legal Services must also maintain a working knowledge and provide direction to ensure compliance of federal, state, and local laws and regulations and provide information and recommendations to District staff. 


This position reports to the Business Administrator for Timpanogos School District.

Essential Functions

  • Provide legal representation and law-related services to the District
  • Provide training to District staff on policies, legal requirements, and other relevant topics.
  • Suggest revisions to policies and procedures to ensure the District is compliant with all federal, state, and local laws and regulations.
  • Advise on issues related to the Governmental Records Access Management Act (GRAMA) and represent the District in any GRAMA appeals or State Records Committee hearings.
  • Support the Title IX, 504 and Title VI Coordinators as well as attend occasional student IEP or 504 meetings.
  • Conduct investigations as necessary.
  • Act as a liaison with the Attorney General's Office on litigation matters for the District.
  • Provide information or legal research to the Board of Education as needed and requested.
  • Interface with and provide legal counsel and assistance regarding interagency relationships and Interlocal Agreements.
  • Develop and maintain the confidence and trust of senior leadership at the district. Must be cooperative, honest, trustworthy, dependable and able to maintain confidentiality.
  • Attend work sessions and meetings with the District staff when requested.
  • Conduct themselves in a professional and civil manner. Possess the necessary skills to manage stressful situations and react appropriately, professionally and promptly to unexpected dilemmas and situations.
  • Demonstrate excellent interpersonal skills with the ability to cooperatively interact and work with school personnel, parents, students, and the general public.

  • Be knowledgeable of current computing technologies and able to effectively utilize software applications appropriate to position responsibilities.
  • Prepare and maintain a wide variety of written materials and confidential records (e.g., student records, personnel files, reports, memos, notes, investigations, etc.) to document activities, comply with processes and legal requirements, convey information, and ensure collection of appropriate documentation of legal matters.
  • Work under limited supervision utilizing time-management and prioritization strategies while accurately processing detailed information and meeting deadlines.
  • Adapt to changing work priorities and work with frequent interruptions, as required.
  • Maintain regular and predictable in-person attendance to fulfill job requirements efficiently and effectively.
  • Perform other related duties as assigned to ensure the efficient and effective functioning of the District..
  • Perform other duties as directed.

Other Functions

  • Performs other duties as assigned for the purpose of ensuring efficient operations.
  • Experience, knowledge, and understanding of the laws and general legal and operational principles related to K-12 public education, including but not limited to civil rights law, contract law, labor and employment law, special education law, contracts, real estate, litigation, family, personal injury, risk management and other areas of the law that pertain to public education.
  • High analytical ability to reason and analyze situations based upon legal principles and practical application in the school environment.
  • Experience with conducting investigations.
  • Experience with Title IX issues.
  • Experience working with administrative agencies (UALD, EEOC, OCR, USBE, Utah Legislature).
  • Experience working with GRAMA, OPMA, FERPA, and other laws specific to governmental entities.
  • Competent in conducting thorough and accurate legal research, investigations, and have excellent legal/policy writing skills.
  • Providing assistance to school staff in evaluating student eligibility and accommodation plans to assure the District's legal compliance with Individuals with Disabilities Education Act (IDEA) and Section 504.
  • Review, revise, negotiate, and draft contracts and other legal documents involving the District, such as construction, remodels, additions, capital projects, goods and services, etc.
  • Advise on public employment law issues and related human resource matters.
  • Be involved with employee hearings and other administrative hearings involving the District, such as the Equal Employment Opportunity Commission, Utah Antidiscrimination Labor Division (UALD), and Utah Department of Workforce Services.
  • Coordinate with outside legal counsel on lawsuits and other legal matters involving the District.
  • In-person daily attendance.
  • Some travel may be required

Qualification Requirements

  • Be fingerprinted and clear a criminal background check.
  • Hold a law degree from an accredited law school and be an active member of the Utah State Bar.
  • Requires a minimum of 3 years of previous job-related work experience with demonstrated competence. A minimum of three (3) years' experience in the practice of law, including but not limited to litigation experience in the courtroom, administrative hearings and or administrative law and education.
  • Knowledge of and experience working with federal and state civil rights laws, including Title VII, Title IX, Section 504 of the Rehabilitation Act, and the Americans with Disabilities Act.
  • Knowledge of and experience working with federal and state constitutional provisions delineating individual rights of students and employees, including the First, Fourth, and Fourteenth Amendments of the U.S. Constitution.
  • Experience with equal opportunities for ethnic, racial, and religious minorities.
  • Experience conducting sensitive and complex investigations is preferred.
  • Experience interacting with law enforcement personnel is preferred.
  • Experience organizing and conducting neutral hearings for students or employees is desirable.
  • Experience working with employment law with strong knowledge of laws and case law that impacts the workplace.
  • Experience with cost-effective management of outside legal resources.
  • Requires outstanding interpersonal skills and the ability to work well with various stakeholders and patrons, work in a team environment, and provide high levels of customer service.
  • Interacts effectively with principals and teachers, parents, law enforcement officers, lawyers, senior District office staff, and the general public.
  • Is flexible and able to work in a fast-paced environment, and skilled at directing tasks and assignments with well-educated, opinionated, and outgoing personalities.
  • Professional communication skills, including excellent written and verbal communication skills. Confident, articulate, and professional speaking abilities; empathic listening and persuasive speaking skills.
  • Extensive knowledge of applicable laws, rules, regulations and/or board policies and district procedures.
  • Requires a valid driver's license.

Physical Requirements

  • While performing the duties of this job, the employee is regularly required to speak and/or hear. The employee is frequently required to stand; walk; reach with hands and arms and stoop, kneel, or crouch. The employee is occasionally required to use hands to handle or feel and must occasionally climb or balance.
  • The employee must frequently lift and/or move up to 10 pounds and occasionally lift and/or move up to 25 pounds.
  • Specific vision abilities required by this job include close vision, distance vision, color vision, peripheral vision, and depth perception.
