Liberty Mutual has an immediate opening for a Senior Technical Claims Specialist on a team primarily dedicated to handling Construction Defect claims. The Senior Technical Claims Specialist determines coverage, investigates highly complex commercial casualty claims, determines liability, sets and adjusts reserves, evaluates the claim, manages the litigation, negotiates a settlement, authorizes and pays or denies the claim, in whole or in part. The Senior Technical Claims Specialist also demonstrates the highest level of expertise and sound judgment in complex matters; often serves as a subject matter expert. In this position, you may handle primary, umbrella and excess claims, directly or as a Third-Party Administrator (TPA), including Wrap-up/Controlled Insurance Programs (CIP, OCIP, CCIP, etc.). Policy Holders retention programs may include Deductibles, Self-Insured Amounts and/or Self-Insured Retentions that can range from Zero ($0.00) to very large, fully fronted and Captives.
Please note, if you reside within 50-miles of certain offices, you will be required to work from the office a minimum of two days each month. This policy is subject to change. Current office locations include Bala Cynwyd, PA; Boston, MA; Hoffman Estates, IL; Indianapolis, IN; Lake Oswego, OR; Las Vegas, NV; Plano, TX; Suwanee, GA; Syracuse, NY; Tampa, FL; and Weatogue, CT.
Senior Technical Claims Specialist I Salary: $97,000 to $125,000.
Responsibilities:
- Determines coverage (including additional insured and contractual tenders in and out), prepares concise and thoughtful coverage positions letters, investigates the claims, determines liability, sets and adjusts reserves (Loss and Supplementary Payments/Allocated Loss Adjustment Expense – proactive and reactionary), evaluates the claim, negotiates a settlement, authorizes and pays the claim; may deny claims; may deny coverage and/or manage coverage litigation.
- Manages concise file documentation throughout life of claim, including key data capture for trends and analytics; electronic document management. Certain Policy Holders have remote access to file notes and/or documents for their Risk Management. Prepares separate reporting where claims meet certain criteria, including Large Loss Reports.
- Review lawsuit and supporting documentation; reviews construction contracts and Certificates of Insurance; Establish resolution strategies to be taken to resolve claims, coverage disputes and/or lawsuits. Determines coverage, allocation, co-carrier contributions and time-on-risk, covered and non-covered damages, amounts owed, discovery plans, setting reserves and negotiations.
- Manages responses to contractual, common law and additional insured tenders, both in and out, and from multiple perspectives from the Owner, Developer, Construction Manager, General Contractor and Subcontractors of all trades.
- Communicates with internal and external stakeholders where appropriate, including but not limited to Policy Holders, Agents, Brokers, Co-Carriers, Excess Carriers, Fronting Carriers, Associated Counsel, Underwriting, Client Services, Billing and Management.
- Where appropriate, establishes working team that may include, but not be limited to Defense Counsel, Home Office Legal, Home Office Litigation, and Outside Coverage Counsel, based on allegations established in suit and claim circumstances.
- Responsible for managing the practices and billing activities of outside counsel. Accountable for security of financial processing of claims, as well as security information contained in claims files.
- Trains and mentors staff as appropriate; manages relationships and acts as liaison with various business partners (e.g., Underwriting, Reinsurance, Etc.).
- Keeps abreast of existing and proposed legislation, court decisions and trends and experience pertaining to specialty coverage issues. May analyze the impact upon claims policies and procedures and advises Claims Management so appropriate action can be taken where required.
- Leads and participates in special projects and performs other duties as assigned.
Qualifications
- Advanced to expert knowledge of Construction Defect/Commercial Casualty claims investigation, coverage, reserving, expense management, resolution strategy, negotiation, litigation management, claims evaluation as well as the insurance legal and regulatory environment.
- Advanced to expert level of skill in the area of customer focus, gaining support, teamwork, and adaptability.
- Expert ability to identify and solve problems, achieve results and execute thoroughly.
- Demonstrated ability to work independently, mentor other employees, and serves as a subject matter expert as normally acquired through 7 or more years of experience.
